1. Acceptance of Terms

By accessing or using Buildix ("the Service"), operated via buildix.trade, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. The Service is provided by The Buildix Team ("we", "us", "our").

2. Description of Service

Buildix is a Software-as-a-Service (SaaS) platform providing real-time orderflow analytics and data visualization tools for cryptocurrency perpetual futures markets, specifically Hyperliquid. The Service includes a screener, deep view analytics, AI-powered market analysis (using your own API keys), portfolio tracking, and alert systems.

Buildix is NOT: a financial advisor, a broker, a custodian of funds, a crypto-asset service provider (CASP), or an investment platform. We do not execute trades, hold funds, or provide personalized investment recommendations.

3. Non-Custodial Nature

Buildix never has access to, custody of, or control over your funds. Exchange API keys you provide are used solely to read market data and, in the future bot builder phase, to execute orders on your behalf on your exchange account. API keys are encrypted at rest. Wallet connections for portfolio tracking are read-only. You retain full control of your assets at all times.

4. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract in your jurisdiction. The Service is not available in jurisdictions where cryptocurrency trading analytics services are prohibited.

5. Account and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use. We are not liable for losses arising from unauthorized access to your account.

6. Subscription and Payments

Buildix offers Free, Pro ($19/month), and Whale ($49/month) subscription tiers, plus a one-time 7-day free trial of Pro features (one trial per account, no payment required). Paid subscriptions are billed monthly in cryptocurrency (USDT, USDC, BTC, or ETH).

No refunds. All payments are final. Cryptocurrency transactions are irreversible by nature. You may cancel your subscription at any time; access continues until the end of the current billing period.

7. Disclaimer — AS IS

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not guarantee that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) the data, analytics, signals, or AI-generated analysis will be accurate, complete, or reliable; (c) any trading decisions made using the Service will be profitable.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Buildix, its operators, affiliates, or contributors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of trading opportunities, or financial losses arising from the use or inability to use the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the three (3) months preceding the claim, or fifty US dollars ($50), whichever is greater.

9. Risk Acknowledgment

By using the Service, you acknowledge that you have read and understood our Risk Disclosure Agreement and that cryptocurrency trading carries significant risk of financial loss.

10. AI Advisor Disclaimer

The AI Market Advisor feature uses third-party AI models via your own API keys (BYOK). AI-generated analysis is for informational and educational purposes only. It does not constitute financial advice, investment advice, trading advice, or any other form of professional advice. You are solely responsible for your trading decisions.

11. Acceptable Use

Your use of the Service is subject to our Acceptable Use Policy. Violations may result in immediate account termination without refund.

12. Intellectual Property

All content, code, algorithms, designs, and trademarks associated with Buildix are the property of The Buildix Team. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

13. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections on limitation of liability, disclaimers, and governing law survive termination.

14. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service. Continued use after changes constitutes acceptance.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of Italy. Any disputes shall be subject to the exclusive jurisdiction of the courts of Italy.
